Abstract

One of the rights anybody has is to be able to accomplish his civil rights. However, the law -for the benefit of the individual and that of others- in some cases limits this ability. This limitation -that is called in Shiite jurisprudence "incapacity” (Mahjvryat) has several causes, including: childhood, insanity, diseases causing death and bankruptcy. This essay aims to case study the conditions in which addicts are and the possibilities of considering them as incapable people This paper aims -through an examination of the circumstances of addicts- to investigate the possibility of their being incapacitated.
