The term of soft law is a relatively new concept in international law, reflecting the establishment of rules and principles that are currently non-binding, not fully developed, or politically motivated. The extent to which these laws exist and their nature are influenced by political contexts and developments, which may appear to be non-legal matters. However, the term of soft law is not used in a vacuum devoid of a legal community and system; otherwise, it would lack meaning and applicability, and it is certainly referenced in contexts where it has been examined within the fabric of society and the international legal system. A critical issue in analyzing and reviewing these laws is whether such a designation is real or unreal. In this article, we carefully examine this term, the context for proposing and establishing such laws in international law, and consider it from the perspective of general principles.
